Camera system

What personal data of yours and for what purpose are processed by the camera system? And what is the legal basis for this processing?

A camera system is installed within the internal and external spaces of our organization. A total of 18 outdoor and 45 indoor cameras are installed, which, due to their location, cover the spaces in which patients, persons close to patients, suppliers and other third parties move. The spaces covered by the camera system are always properly and clearly marked. Cameras operate in continuous mode.

Within the camera system, we may process the following personal data: your appearance, gender, approximate age.

The reason for processing these personal data of yours is our legitimate interest in protecting our rights and legitimate interests, in particular the protection of the life and health of patients (e.g., falls), employees, as well as the public entering the premises of ÚHKT, facility security, protection of our and your property, and prevention against vandalism.

Who can view these recordings and is it possible to transfer them abroad?

We basically manage your personal data from the camera system within the organization. We transfer data outside the organization only if required by law or if such transfer is necessary for investigating or proving incidents or unlawful conduct. In accordance with the preceding sentence, the camera recording may be transferred in particular to law enforcement authorities, administrative authorities or courts. In other cases, we will transfer data only on the basis of your explicit consent.

How long and in what form do we retain camera recordings?

The camera system carries out continuous long-term recording of footage. This recording is retained for 5 days. It is then automatically overwritten by new recordings and cannot be restored in any way. We create a copy of the recording only if it captures an event that we need to investigate. We retain this copy in a secure manner for the duration necessary to properly investigate such event and, if legal proceedings are initiated in the matter, for the duration of such proceedings. Recordings are retained in electronic form.

What rights do you have in relation to your personal data?

As a data subject, the legal system grants you a number of rights. As a subject who may be captured, you have a number of rights.

Right of access to personal data

You certainly have the right to know what data is being processed about you, for what purpose, for how long, where we obtained this data, and whether and to whom we transfer it. At the same time, you have the right to be informed of other rights concerning this data. This document is intended to serve in particular for your information, however, we are prepared to provide you with confirmation or clarification on any point of this information.

If you request it, we will also provide you without undue delay with a copy of the personal data being processed. For this copy, especially if requested repeatedly, we are entitled to charge a reasonable fee in connection with administrative costs. If you submit this request in electronic form, we will automatically assume that you wish to receive the information also in electronic form. However, you have the option to request another method. Please note that the right to obtain a copy of the personal data being processed cannot adversely affect the rights of other persons. This also refers to the rights of persons who are captured in the same recording.

At the same time, please note that recordings from the camera system are retained only for 5 days. After that, they are overwritten and we cannot therefore comply with your later request for a copy of the recording.

Right to rectification of personal data

Generally, in the event you discover that the personal data we process about you is inaccurate or incomplete, you have the right to request that we supplement or correct it without undue delay. However, this right cannot be exercised in connection with camera recordings, as it is technically impossible.

Right to restrict processing of personal data

This right allows you in certain cases to request that some of your personal data be marked and these data no longer be the subject of further processing for a certain period of time. This is not the same as the right to erasure, as restriction of processing is not permanent. You have the right to request that we restrict the processing of your personal data in the event that:

  • you dispute the accuracy of the data we process about you for the necessary time to verify their accuracy,
  • the processing is without a legal basis (e.g., beyond the scope of data we are entitled to process), but instead of erasure you prefer restriction of processing, for example because you expect that you will provide us with this data in the future anyway,
  • we no longer need to process your personal data, but you require it for the establishment, exercise or defense of your legal claims,
  • you lodge an objection against processing (see the next point of information for this right).

If processing is restricted, data may be processed only with your consent, or for the purpose of establishing, exercising or defending legal claims, for the protection of the rights of another person, whether natural or legal, or for reasons of important public interest.

We draw your attention to the fact that the applicability of the right to restrict processing is limited in connection with camera recordings, particularly due to their short-term processing.

Right to object to processing of personal data

You can exercise the right to object to the processing of personal data only in situations where we process some of your personal data in the public interest or on the basis of our legitimate interest. If this happens, we will continue to process your personal data only if we can demonstrate compelling legitimate reasons (in particular if we need them for the establishment, exercise or defense of our legal claims).

We draw your attention to the fact that the applicability of the right to restrict processing is limited in connection with camera recordings, particularly due to their short-term processing.

Right to lodge a complaint with the supervisory authority

The exercise of the rights previously stated does not in any way affect your right to lodge a complaint with the Office for Personal Data Protection, through the contact details specified at the beginning of the document. Current information can be found directly on the website of the Office for Personal Data Protection (www.uoou.cz). You can file a complaint at any time you have doubts about whether your personal data is being processed as it should be, i.e., unlawfully or in violation of legal regulations.

Right to erasure

In some cases, as a data subject, you also have the right to have your personal data erased. We generally proceed to erase your personal data when we no longer need it and have no legal reason to process it. The camera recording will be erased upon exercise of your right, unless there is a more significant legitimate interest on our part, consisting in particular in the establishment, exercise or defense of legal claims.

How can individual rights be exercised?

In all matters related to the processing of your personal data, whether it is a query, exercise of a right, filing a complaint or anything else, you can contact our data protection officer in the following ways:

We will process your request without undue delay, but at the latest within one month. In exceptional cases, particularly due to the complexity of your request, we are entitled to extend this period by a further two months. We will of course inform you of any such possible extension and its justification.
