Information for former employees

If we have cooperated with you in the past within the framework of an employment or similar relationship (hereinafter referred to as "employment relationship"), we are entitled (and in some cases obliged) to continue processing some of your personal data, albeit in a narrower scope.

What personal data of yours and for what purpose do we process? What is the legal basis and duration of this processing?

Even after the employment relationship ends, we continue to process the following data about you:

  • identification data: name, surname, title, date of birth and gender;
  • contact data: telephone number, email address;
  • data on health insurance, data on marital status,
  • data related to work performance – data on education, health fitness, good conduct, data on completed training, work evaluation, etc.

Within the records of former employees, we process some of your personal data based on a legal obligation (in particular, data contained in the employment contract and salary slips). We process this data for up to 30 years after the end of the employment relationship, based in particular on legal regulations governing the organization and implementation of social security.

Based on our legitimate interests, we then process some of the other data mentioned above, as well as data related to work performance for the purpose of protecting our legal claims. You have the right to object to such processing at any time, which can be exercised in the manner described in more detail below. For these purposes, we process personal data for the duration of the limitation period (for a maximum of 10 years from the end of the employment relationship) of claims arising from or related to the employment relationship. In the event that court, administrative or other proceedings are initiated, we process your personal data in the necessary scope for the entire duration of such proceedings.

In what form are my personal data processed?

We process your data in both electronic and paper form.

Who can we provide your personal data to?

We manage your personal data within our organization, and we provide it to third parties in principle only with your consent. However, in some cases we are obliged to provide your personal data to other recipients even without your consent.

In some cases, we are entitled to further disclose your data based on law. In particular, this may involve disclosure of your data to state administration bodies, we provide it in the event of investigation of insurance events to insurance companies with which ÚHKT is insured for processing, based on our legitimate interest.

In some cases, we also use external suppliers, especially regarding technical support of our information system. During these activities, some of your personal data may be processed. External suppliers are in the position of so-called processors and have a written contract with us that obligates them to comply with strict principles in handling your data. In such a case, your consent is not required for the purposes of performing the processing activity, since such processing is enabled directly by legal regulations. Be assured that we select our suppliers according to strict criteria, so you do not need to worry about your data. Currently, the following categories of processors process your personal data: Processor of archival services.

We do not in principle transfer your personal data abroad. This can only happen exceptionally if you give your consent or if it is required by law.

What rights do you have in relation to your personal data?

As a data subject, the legal system grants you a range of rights. As a former employee, you have the following rights in relation to your personal data.

Right of access to personal data

You certainly have the right to know what data is being processed about you, for what purpose, for how long, where we obtained this data, whether and to whom we provide it. At the same time, you have the right to information about other rights concerning this data. This document is intended in particular to inform you, however, we are ready to provide you with confirmation or clarification on any point of this information.

If you ask us to do so, we will provide you without undue delay with a copy of the processed personal data. We are entitled to charge a reasonable fee for this copy, especially if requested repeatedly, in connection with administrative costs. If you submit this request in electronic form, we will automatically assume that you are interested in receiving the information also in electronic form. However, you have the option to request a different method. Please note that the right to obtain a copy of processed personal data may not adversely affect the rights of other persons.

Right to rectification of personal data

If you find that the personal data we process about you is inaccurate or incomplete, you have the right to request that we supplement or correct it without undue delay.

Right to restrict processing of personal data

This right allows you in certain cases to request that some of your personal data be marked and these data are no longer subject to further processing for a certain period. This is not the same as the right to erasure, since restriction of processing is not permanent. You have the right for us to restrict the processing of your personal data if:

  • you contest the accuracy of the data we process about you, for the necessary time for the accuracy to be verified,
  • processing is without a legal basis (e.g., beyond the scope of data we are entitled to process), but instead of erasure you prefer to restrict processing, for example because you expect that you will provide us with this data in the future,
  • we no longer need to process your personal data, but you require it for establishing, exercising or defending your legal claims,
  • you lodge an objection to processing (see the next point for information on this right).

If processing is restricted, data may only be processed with your consent, or for the purpose of establishing, exercising or defending legal claims, for the protection of the rights of another person, whether natural or legal, or for reasons of important public interest.

Right to object to processing of personal data

You can exercise the right to object to processing of personal data only in situations where we would process some of your personal data in the public interest or based on our legitimate interest. If this happens, we will continue to process your personal data only if we demonstrate compelling legitimate reasons for it (in particular, if we need it for establishing, exercising or defending our legal claims).

Right to lodge a complaint with a supervisory authority

By exercising the rights mentioned so far, your right to lodge a complaint with the Office for Personal Data Protection is in no way affected, through the contact details provided at the beginning of the document. Current information can be found directly on the website of the Office for Personal Data Protection (www.uoou.cz). You can lodge a complaint at any time when you have doubts as to whether your personal data is being processed as it should be, i.e. unlawfully or in breach of legal regulations.

Right to erasure

In some cases, as a data subject you also have the right to have your personal data erased. We generally proceed to erase your personal data when we no longer need it and have no legal reason to process it. Furthermore, we will erase your data if it was processed based on consent and that consent was withdrawn.

Please note that even if it is one of the reasons for erasure, it does not mean that we immediately delete all your personal data. This right does not apply if processing of personal data is still necessary to comply with our legal obligations, for archival purposes, scientific or historical research or for statistical purposes, or for establishing, exercising or defending our legal claims.

Right to withdraw consent

If it is cases where your personal data is processed based on consent, you also have the right to withdraw consent at any time. However, withdrawal of consent will not affect the previous processing we carried out before its withdrawal.

How can individual rights be exercised?

In all matters related to the processing of your personal data, whether it is a question, exercise of a right, lodging a complaint or anything else, you can contact our data protection officer in the following ways:

We will process your request without undue delay, but within one month at the latest. In exceptional cases, in particular due to the complexity of your request, we are entitled to extend this period by a further two months. We will of course inform you of any such possible extension and its justification.
